Top 10 Posts of 2015 #8: Condo’s pet restriction muzzles couple’s Human Rights claim
December 24, 2015
The number of Toronto condo residents that own pets is so high that some enterprising developers are building in dog baths and other pet-friendly features.
We all love our pets. For some of us, they’re our children. Some pets are treated better than children (although that’s likely because they don’t talk back and are more easily trained.)
If you’re moving into a house with a pet or two, there are no concerns. Where you need to pay attention to the fine print is when you’re moving into a condominium. According to Gerry Hyman, the Star’s Condo Law columnist, condo boards can’t ban pets entirely, but they are allowed to restrict them. “The courts have upheld rules limiting the number or size of pets in a unit,”according to Hyman.
That being said, take a look at this recent Toronto Star article that details the sad story of a dog named Peaches. The owners moved in with a 40 pound dog knowing the condo restricted pets to 25 pounds or less.
